Device Warranty Agreement

This Agreement is entered into between the customer (“Subscriber”) and Medical Life Club LLC, located at 30 N Gould St Suite N Sheridan Wyoming (“Company”), as an optional add-on to the standard Monitoring Service Agreement.

1. Warranty Plan Coverage

For a fee of $4.95 per month, Subscriber is enrolled in the Medical Life Club Device Warranty Program (“Warranty Program”), which provides the following protections and benefits:

  • Full Coverage for Damage or Malfunction
    Any damage, defect, or malfunction of the medical alert device will be covered, regardless of cause (excluding theft, loss, or intentional destruction), and the device will be replaced at no additional cost to Subscriber.
  • No Out-of-Pocket Replacement Fees
    If the unit is damaged or stops functioning properly, Subscriber will receive a replacement unit at no charge for the device, shipping, or processing.
  • Eligibility for Free Device Upgrade
    After 24 months of continuous enrollment in the Warranty Program, Subscriber becomes eligible to request a free upgraded unit, if and when available, subject to Company inventory and technical updates.
  • Annual Free Device Swap
    Subscriber is entitled to one free device swap per calendar year. This includes switching between unit styles (e.g., pendant to wrist unit or wrist unit to pendant) to better suit Subscriber’s preference or needs. Additional swaps may be requested for a fee.
  • Lost or Stolen Device is covered under this warranty with a $99 deductible to be paid prior to shipping new unit.

2. Term & Billing

  • This Warranty Program is optional and may be added to or removed from the Subscriber’s account at any time by written request.
  • The cost of the warranty, $4.95 per month, will be billed separately from the Subscriber’s monitoring service agreement and is subject to applicable taxes and fees.
  • Cancellation of the monitoring service will automatically terminate this Warranty Program.

3. Exclusions

This warranty does not cover:

  • Damage due to intentional misuse, negligence, or fraudulent activity.
  • Devices not returned to the Company upon upgrade, swap, or replacement unless unit is lost or stolen and deductible as explained herein is paid in full prior to device ship. .

4. Termination

  • Subscriber may cancel this Warranty Program at any time by providing written notice via email or phone.
  • No refunds will be provided for partial months.
  • The Company reserves the right to cancel the Warranty Program for any Subscriber for abuse, fraud, or misuse of the service.

5. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflicts of law principles.

6. Consent and Acknowledgment

The Device Warranty Program is entirely optional and not required for participation in Medical Life Club’s standard monitoring service.

By enrolling in the Device Warranty Program and submitting payment, the Subscriber affirms their full understanding and acceptance of the terms and conditions set forth in this Agreement. The Subscriber also agrees to the terms referenced during the optional warranty voice verification process, including the monthly billing, eligibility for upgrades, device swap policies, and the exclusions and limitations described herein.

In the event of a lost or stolen device, a deductible of $99 per occurrence will apply. This fee must be paid before a replacement unit is shipped.

This Device Warranty Agreement is supplemental to and governed by the terms of the Medical Life Club Monitoring Services Agreement. In the event of any conflict, the terms of the Monitoring Services Agreement shall control.
